Terms of Service

These terms govern the use of NOVA PMS and its cloud services for hospitality property management.

1. Identity and acceptance

NOVA PMS is a cloud software service owned and operated by KHALID SAAD Q ALANAZI from Al Khobar, Saudi Arabia. “Customer” means the property or person that creates an account or subscribes to the service.

By creating an account or using the service, the Customer confirms that they have read and accepted these Terms, the Privacy Policy, and the Cancellation and Refund Policy. A user acting for an organization confirms that they are authorized to bind it to these Terms.

2. Service description

NOVA provides tools to manage properties, units, guests, reservations, payments, reports, and users. It may include third-party integrations such as calendar synchronization, email, and payment services.

Features may be changed, improved, or discontinued for operational or security reasons. NOVA will seek to notify Customers of material changes where reasonably possible.

4. Subscriptions and payment

Prices, limits, and billing periods are shown on the plans page or in the subscription offer accepted by the Customer. Payments may be collected by an external payment provider; NOVA does not store complete card numbers.

Where automatic renewal applies, the Customer authorizes charges for each billing cycle until cancellation. The published Cancellation and Refund Policy applies to payments and duplicate charges.

6. Guest data and property responsibility

The property determines why and how guest data is collected and remains responsible for lawful collection, accuracy, privacy notices, required consents, and data subject requests. NOVA processes this data to provide the service under the property’s instructions.

The Customer must not enter excessive data and must limit employee access to those who need it for their work.

7. Third-party integrations

Some features depend on third-party services subject to their own terms and availability. Booking iCal is calendar synchronization, not a pricing connection or a real-time guarantee, and updates may be delayed by the provider or synchronization schedule.

NOVA does not guarantee the continued availability of third-party services or the accuracy of data received from them. Customers should review important reservations and alerts.

8. Availability, maintenance, and backup

NOVA aims to provide a stable service but does not guarantee uninterrupted availability. Planned maintenance, emergencies, and hosting or connectivity failures may occur.

NOVA applies reasonable backup procedures. The Customer remains responsible for retaining copies of reports and critical data required for legal or operational purposes.

9. Intellectual property

NOVA software, design, trademarks, templates, and documentation remain owned by the service owner or licensors. The Customer receives a limited, non-exclusive, non-transferable right to use the service while the account is active.

The Customer retains ownership of submitted data and grants NOVA the permission necessary to process and host it and provide the service.

10. Suspension and termination

An account may be suspended for non-payment, security risk, material breach of these Terms, or a lawful request. Customers may cancel under the Cancellation and Refund Policy.

After cancellation, Customers have thirty days to request data export, after which operational data may be deleted. Backups may remain for up to ninety days unless the law requires particular records to be retained longer.

11. Limitation of liability

The service is provided as available and to the extent permitted by law. NOVA is not responsible for property operational decisions, inaccurate Customer data, account misuse, or third-party service failures.

These Terms do not exclude liability that cannot legally be excluded. Otherwise, direct liability for service-related claims is limited to fees paid by the Customer during the three months before the event giving rise to the claim.

12. Changes and governing law

These Terms may be updated as the service or legal requirements change. The latest revision date will be published here. Continued use after an update takes effect constitutes acceptance, and NOVA will seek to notify Customers of material changes where reasonably possible.

These Terms are governed by the laws of Saudi Arabia. Disputes should first be addressed amicably and then through the competent courts in Saudi Arabia. If interpretations differ, the Arabic version prevails.
